This Acceptable Use Policy ("AUP") describes the rules and restrictions that apply to your use of the BizNetrix platform and services. This AUP is incorporated into and forms part of our Terms of Service. By using BizNetrix, you agree to comply with this AUP.
1. Permitted Use
You may use BizNetrix for lawful business purposes, including but not limited to:
- Managing customer relationships (CRM).
- Running marketing campaigns and email sequences to opted-in contacts.
- Generating and tracking leads and sales pipelines.
- Automating business workflows and communications.
- Analysing business metrics and reporting.
2. Prohibited Activities
You must not use BizNetrix to:
2.1 Illegal Activity
- Violate any local, national, or international law or regulation.
- Facilitate fraud, money laundering, or deceptive practices.
- Infringe upon intellectual property rights of others.
2.2 Harmful Communications
- Send unsolicited bulk email (spam) or messages to contacts who have not given explicit consent.
- Send harassing, threatening, abusive, defamatory, or offensive communications.
- Impersonate any person or entity.
- Send phishing or social engineering communications designed to deceive recipients.
2.3 System Abuse
- Attempt to gain unauthorised access to BizNetrix systems or other users' accounts.
- Conduct denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks.
- Upload or distribute malware, viruses, ransomware, or any malicious code.
- Use automated bots, scrapers, or crawlers against the platform without prior written consent.
- Circumvent any security measures or access controls.
2.4 Restricted Industries
BizNetrix may not be used by businesses operating in the following industries without prior written approval:
- Adult content or entertainment
- Firearms, ammunition, or weapons sales
- Gambling or betting services
- Cryptocurrency exchanges or ICOs
- Tobacco or drug-related products (where not explicitly legal)
- Multi-level marketing (MLM) or pyramid schemes
3. Email & Messaging Standards
When using BizNetrix for email marketing or bulk messaging, you must:
- Only contact recipients who have given explicit opt-in consent.
- Include a clear and functional unsubscribe mechanism in every marketing email.
- Honour unsubscribe requests promptly (within 10 business days).
- Include your legal business name and physical address in commercial emails.
- Comply with applicable anti-spam laws (e.g., CAN-SPAM, CASL, GDPR).
- Maintain bounce rates below 5% and spam complaint rates below 0.1%.
4. Data & Privacy Obligations
You are responsible for ensuring that any personal data you upload to BizNetrix:
- Was collected lawfully and with appropriate consent.
- Is handled in accordance with applicable data protection laws (e.g., GDPR, CCPA).
- Does not include sensitive personal data (e.g., health records, payment card numbers) unless your plan explicitly supports such use.
5. Resource Usage
You must not use the Service in a manner that places an unreasonable or disproportionate load on our infrastructure. We reserve the right to throttle, suspend, or terminate accounts that excessively consume system resources in a way that degrades service for other users.
6. Enforcement
Violation of this AUP may result in:
- A warning and request to remediate.
- Temporary suspension of your account.
- Permanent termination of your account without refund.
- Reporting to relevant law enforcement authorities.
We reserve the right to take any of these actions at our sole discretion and without prior notice where we determine that immediate action is necessary.
7. Reporting Violations
If you become aware of any violation of this AUP, please report it to us at info@biznetrix.com. We take all reports seriously and will investigate promptly.
8. Changes to This Policy
We may revise this AUP at any time. Material changes will be communicated via email or a notice on the platform. Continued use of the Service constitutes acceptance of the updated AUP.
